Terms & Conditions

These Terms & Conditions apply to design services provided by KitCreativity.

By engaging KitCreativity for a project, you acknowledge and agree to these terms together with any specific proposal, quotation, scope of work or written agreement issued for the project.

1. Services

KitCreativity provides creative and design services including, but not limited to:

  • Brand identity design
  • Logo design
  • Packaging and product label design
  • Marketing and promotional design
  • Website design
  • Website design and development coordination
  • Print and production artwork
  • Ongoing creative support

The exact services, deliverables, timeline and project scope will be confirmed in the relevant proposal or quotation.

2. Project Scope

Each project is based on the agreed scope of work.

Requests that materially change the original scope may be treated as additional work and may require an additional fee or revised timeline.

KitCreativity will communicate any significant scope changes before proceeding where reasonably possible.

3. Project Commencement

A project may commence once the required approval, deposit or initial payment has been received, depending on the terms agreed for the project.

The project timeline will generally begin once KitCreativity has received the necessary information, content, assets and approvals required to begin the work.

4. Client Responsibilities

The client is responsible for providing accurate information, content, specifications, references, brand assets and other materials required for the project.

The client is also responsible for reviewing work and providing feedback within a reasonable timeframe.

Delays in providing content, feedback, approvals or other required materials may affect the agreed project schedule.

5. Design Concepts and Revisions

The number of initial concepts and revision rounds included in a project will be specified in the relevant quotation or proposal.

A revision refers to reasonable adjustments to an agreed design direction.

Requests for substantially new concepts, changes to an approved direction, or work outside the agreed revision allowance may incur additional fees.

6. Approval and Final Artwork

The client is responsible for carefully reviewing and approving final artwork before production or publication.

Once final artwork has been approved, KitCreativity is not responsible for errors that were present in the approved artwork but were not identified by the client.

Where appropriate, KitCreativity may provide production-ready files in the formats agreed in the project scope.

7. Payment

Fees, deposits, payment schedules and payment methods will be stated in the relevant proposal, quotation or invoice.

Unless otherwise agreed in writing, final files may be withheld until outstanding payments have been received.

Additional work outside the agreed scope may be invoiced separately.

8. Cancellation or Suspension

If a client cancels or suspends a project after work has commenced, fees may remain payable for work already completed and time already committed.

Any unused portion of a payment will be handled according to the specific circumstances and agreed project terms.

9. Intellectual Property

Unless otherwise agreed in writing, ownership of the final approved original design work will transfer to the client after full payment has been received.

KitCreativity retains ownership of preliminary concepts, unused design directions, working files, drafts and rejected concepts unless otherwise agreed.

Third-party materials such as fonts, stock photography, illustrations, plugins, templates or other licensed assets may be subject to their own licence terms and may not automatically transfer to the client.

10. Source and Working Files

Editable source files will only be supplied when specifically included in the agreed scope.

Where editable files are not included, KitCreativity may provide the agreed final production files such as PDF, AI, EPS, PNG or JPG, depending on the project.

11. Third-Party Materials

Where a project requires third-party assets, the client may be responsible for purchasing or licensing those assets unless otherwise agreed.

KitCreativity will not knowingly incorporate third-party materials in a way that violates their applicable licence terms.

12. Website Design and Development

For website projects, KitCreativity may provide design, WordPress customisation, content structure, basic SEO integration and related creative services as specified in the project scope.

Where website development, hosting, plugins, domains, third-party integrations or other technical services are provided by another party, KitCreativity is not responsible for failures or changes caused by those third-party services.

Ongoing website maintenance, hosting, security, plugin updates and technical support are not included unless specifically agreed.

13. Portfolio and Self-Promotion

Unless otherwise agreed in writing, KitCreativity may display completed work in its portfolio, website, social media, professional profiles and promotional materials for the purpose of demonstrating its design work.

Confidential or unreleased work will not knowingly be published before the client has publicly released it, unless permission has been provided.

14. Confidentiality

KitCreativity will treat confidential project information shared by clients with reasonable care.

Clients should identify information that is confidential or subject to specific confidentiality requirements before sharing it.

Where a separate Non-Disclosure Agreement (NDA) is required, the NDA will take precedence over this section to the extent of any conflict.

15. Limitation of Liability

KitCreativity will provide services with reasonable professional care and skill.

To the extent permitted by applicable law, KitCreativity will not be liable for indirect, incidental or consequential losses arising from the use of the design work, website, third-party services or materials supplied by the client.

Nothing in these Terms & Conditions excludes any liability that cannot lawfully be excluded.

16. Changes to These Terms

KitCreativity may update these Terms & Conditions from time to time.

The latest version will be published on this page. Specific project agreements, proposals or quotations may contain additional terms applicable to that project.
